She doesn’t know they weren’t engaged, even though it was difficult to tell because of the rough translation.
The Prince only mentioned it twice. The first time she didn’t know it was him, and the second he posed it as a rhetorical question when making the contract.
She told him that, if he wasn’t engaged, there would be no reason for their affair. He then backtracked and agreed to keep the ruse going until he “gets his fiancee back”.
With that and her bias from knowing the original story, it makes sense she wouldn’t realize (though I agree it’s frustrating)
